Contrary to views of Abayomi Shogunle of the rapid response unit, an Assistant Commissioner of police who took to his twitter handle and said sex in public places or in a car is not a crime adding that such act is consensual provided it is done with the opposite sex.
But this submission is said not to be what is obtainable in Lagos state going by its existing laws.
Putting them into proper perspective after its attention has been drawn to it, the Lagos state commissioner of police, Mr Imohimi Edgal had instead warned Lagos residence not to engage in sex inside any vehicle in public places, in a car and in public places as against the submission of Acp Abayomi Shogunle.
A statement from the Lagos state public relation officer Csp chike Oti said a sequel to the development, the Lagos state commissioner of police has been advised by the director of public prosecution of the state ministry of justice and its legal department of the state police command with a location at Panti.
He said having been given the relevant section of the law, is not possible in Lagos state to have such activities as the state laws frown at it
“Section 136 of the criminal law of Lagos state provides that any person who commits any act of gross indecency with another person in public commits an offence and liable on conviction to three years imprisonment“
“It must be noted that section 134 which deals with offences against mortality particularly section 134(a) have it that indecent act in a public place makes both parties engaging in the act liable to imprisonment for 2 years”
In the same vein, section 231 of the criminal code act which is a federal law and applicable in states other than the modern states where panel code is applicable also make indecent act punishable
Continuing, Oti said going forward the authority of the Lagos state police command hereby declares that the assertion that sex in a car in public places remained to misplace as the provisions of the criminal law of Lagos state prohibits such acts in public even if it is done with the consent of the other party
“The Lagos state commissioner of police, Mr Imohimi Edgal wants Lagos residence to be guided by the relevant section of the law against such acts”
